Overview

Tomah adopted the state residential and commercial codes with amendments.  Tomah Building Code, § 10-95 (accessed 6/30/2014).

Sec. 10-95. Adoption of building regulations.

(a) One- and two-family dwelling units. The Wisconsin Uniform Dwelling Code, Chs. SPS 320-325 of the Wisconsin Administrative Code, and all amendments thereto, is adopted and incorporated by reference and shall apply to all one- and two-family dwelling units and accessory buildings, including existing units.

(b) Commercial buildings. Chs. SPS 360—366 of the Wisconsin Commercial Building Code (Wis. Admin. Code § 361.01 et seq.), specifically including Wis. Admin. Code § 361.60(4) regarding certification of inspectors; are adopted and incorporated by reference and shall apply to all commercial buildings.

As indicated in the above language, both codes apply to existing buildings.  Also, Tomah has a 50% rule.  "When an existing building is damaged by fire or other cause, or if alterations and repairs are made to an extent of 50 percent or more of the physical value of the building before the damage or alteration, the entire building or structure shall be made to comply with the requirements of this Code for new buildings. If the cost of the alterations or repairs is less than 50 percent of the physical value of the building, the inspection department shall determine to what degree the portions so altered or repaired shall be made to conform to the requirements of this Code."  Tomah Building Code, § 10-94 (accessed 6/30/2014).

Wisconsin adopted the 2009 IBC.  It applies to "code applies to all public buildings and places of employment" with certain exception.  See Wis. Admin. Code § 361.02. The Code defines "public buildings" and "places of employment." Id.

The highest authority is reserved by the state. See Wis. Admin. Code § 361.03. However, local jurisdictions may adopt stricter standard that are not in conflict. Id.  Furthermore, local jurisdiction, including counties, may take on inspection and review responsibilities.  See Wis. Admin. Code § 361.60

Wisconsin adopted the 2009 IEBC, subject to the modifications specified in chapter SPS 366.

Existing Buildings

Existing buildings, meaning buildings that were built in accordance to code at the time of construction, typically merit extra consideration in a current updated code.

As indicated in the above noted adopting language, the code is extended to all existing buildings.  Also, Tomah has a 50% rule.  "When an existing building is damaged by fire or other cause, or if alterations and repairs are made to an extent of 50 percent or more of the physical value of the building before the damage or alteration, the entire building or structure shall be made to comply with the requirements of this Code for new buildings.
